The Copyright Act specifies a number of notices that must be either displayed or communicated to people using copyrighted materials under the statutory and voluntary provisions of the Copyright Act. The following list includes the relevant notices and links to downloadable versions in either a print or electronic installation mode for your convenience.

1. Computers, scanners and photocopying equipment

Computers, scanners and photocopying machines installed in libraries and other places in the educational institution should have affixed on them or in close proximity a notice not less than 297 mm long and 210 mm wide (A4) in the form linked here.

2. Computer terminals

It would be prudent for educational institutions to install a similar notice on terminals which can access the library collection so that the notice appears each time the collection is accessed.

3. A communication under section 49 of the Copyright Act 

Where a library makes a communication to a person under section 49 of the Copyright Act, for the purpose of that person’s research of study a notice must be sent to that person before or when the communication is made in the form linked here. This right should only be exercised by an authorised officer of the library and in conformity with section 49 of the Act.

4. Audio-visual technology

Educational institutions which have facilities for making audio-visual copies of works should affix on the relevant machine or in close proximity a notice not less than 297 mm long and 210 mm wide in this linked form.

5. Communication of Broadcasts

Where copies of broadcasts are communicated the educational institution must give a notice in respect of each communication in the form linked here, unless the communication is made within the premises of the educational institution in such a manner that the people receiving the communication cannot by means provided by the institution:

  • made an electronic copy of the broadcast; or
  • communicate the broadcast.
6. Electronic use notice 

Where an electronic use notice is given:

  • the educational institution must give for each and every electronic copy made and each communication a notice in the form shown in this link here;
  • take all reasonable steps to ensure that a communication made by it can only be received or accessed by the people entitled to receive or access it. In most cases this would be students or teachers.
